PERSON WHO REPORTS PURELY CIVIL MATTER TO POLICE
ISSUE:
Liability of person who reports purely civil matter to Police.
PRINCIPLE:
“When a person reports a purely civil matter to the Police, such a person cannot go scot-free, as the report ought not to have been made at all since it is not within the purview of Police duties. It is a report made mala fide and he will be equally liable for the action taken by the Police irrespective of whether he actively instigated them or not, since he had no business involving the Police in a purely civil matter in the first place. Such conduct, which portrays a disregard of the law and is aimed at using the coercive powers of the State to punish a contracting party in a purely civil matter ought to be mulcted in exemplary damages. In the instant case, the conduct of Mrs. Sokari Davies, an enlightened person who reported such a matter to the police instead of going to court to seek for enforcement of the contract or damages for breach of same, amounted to wickedness, and was mala fide. The charges of cheating and criminal breach of trust could not have a place against the appellant, let alone proving it to a conviction. In fact he deserved an unreserved apology from Mrs. Sokari Davies who set, unjustly and mala fide, the criminal process against the appellant. [Okafor v. HRCRC Facilitates the Release of over 20 inmates of Abakaliki and Afikpo Prisons in Goal Delivery by CJ of Ebonyi State

Every person charged for committing an offence is entitled to be arraigned and tried before a competent court of law within 48 hours. However, certain alleged offenders have been remanded in prison for over two years without trial.

The Chief judge in his magnanimity, backed up by statutory provisions, discharged alleged offenders awaiting trial in a goal delivery exercise. Over 50 persons awaiting trial were discharged

HRCRC is happy to be part of this exercised, facilitating the release of a number of alleged offenders, spare headed by the lawyers in the department of Access to Justice.

National Human Rights Commission Opens in Ebonyi.

HRCRC played host to staff of National Human Rights Commission Abakaliki led by state coordinator Chris Okorie on a courtesy / familiarization visit. NHRC in Abakaliki opened formally on Monday 18th February, 2019.

We are committed to ensuring that all hands are on deck to promote and enforce human rights in Ebonyi state.

2018 WORLD HUMAN RIGHTS DAY

As the year winds to a close, and pre-election activities kick up a notch, HRCRC joined the UN and the rest of the world to mark the 2018 World Human Rights Day with several simultaneous activities both in Abakaliki metropolis and in the local communities via our branches.

In all of Ebonyi, we join in the loud global clamour to stand up for human rights and peculiarly clamour for the end of Electoral Violence and Improprieties with a rally across streets in Abakaliki involving sister CSOs, Volunteers, the press and Security Agencies, in solidarity with the police.

The Nigerian Police, as one of the principal agencies largely acknowledged to be principal perpetuators of human rights violations in Nigeria joined in the solidarity as a public acknowledgement and commitment to work for the upholding of human rights and the values they inhibit.
